1. Overview

These Terms of Service govern your access to and use of all programs, courses, memberships, digital products, and services offered by The Habit Compass, operated by April Dearden, Nutrition Educator and Habit Formation Specialist, doing business as The Habit Compass LLC.

The Habit Compass offers a range of educational products including but not limited to membership programs, self-guided courses, digital downloads, worksheets, frameworks, retreats, special experiences, and future offerings as they become available. These terms apply to all current and future products and services unless separate terms are provided at the time of purchase.

By purchasing any product or membership you agree to these terms in full. If you do not agree, do not complete your purchase.


2. Educational Content Disclaimer

All content provided through The Habit Compass, including but not limited to lessons, modules, worksheets, frameworks, digital downloads, live sessions, community discussion, and written materials, is for educational purposes only.

Nothing in any Habit Compass program or product constitutes medical advice, nutritional counseling, diagnosis, treatment, or a therapeutic relationship. The Habit Compass is not a medical provider, registered dietitian, licensed nutritionist, or mental health professional.

Some Habit Compass programs include educational content discussing GLP-1 and other weight-loss medications. This content is general and educational in nature only. It is not medical advice, it is not a recommendation to start, stop, or change any medication, and it is not a substitute for the guidance of your prescribing provider. Decisions about medication are between you and your licensed healthcare provider.

Always consult a qualified healthcare provider before making any changes to your diet, exercise routine, medication, or health habits. Individual results vary and are not guaranteed.


3. Membership and Billing

Membership programs offered by The Habit Compass are recurring subscriptions billed at the rate shown at checkout. Your first payment is processed immediately upon purchase. Subsequent payments are charged automatically on the same date of each billing period, either monthly or annually depending on the plan selected.

You authorize The Habit Compass to charge your payment method on file for each renewal period until you cancel.

Prices are subject to change with reasonable advance notice provided to active members by email.

3A. Preferred Member Pricing

Active members of The Habit Compass receive Preferred Member pricing on eligible standalone products, retreats, special experiences, and select additional offerings. Preferred Member pricing is available to members holding any active membership in good standing, including Real Life Habit Members, Real Life with GLP-1, and The Compass Room.

The Compass Room includes full access to all digital program content as part of its membership, so Preferred Member pricing for Compass Room members applies to retreats and special experiences rather than to digital products already included in their membership.

Preferred Member pricing is available only while your membership remains active and in good standing. If your membership is cancelled, suspended, or lapses for any reason, you will no longer be eligible for Preferred Member pricing on future purchases.

Preferred Member pricing applies only at the time of purchase. It does not apply retroactively to previous purchases and is not transferable.

The Habit Compass reserves the right to modify, discontinue, or adjust Preferred Member pricing benefits at any time with reasonable advance notice provided to active members by email.


4. Membership Cancellation Policy

You may cancel your membership at any time through your member account portal. To cancel, log into your portal at membership.thehabitcompass.com, navigate to your account settings, and follow the cancellation steps.

Monthly Memberships. Cancellation takes effect at the end of your current monthly billing period. You will retain full access to your membership content through the end of the period for which you have already paid. No partial refunds are issued for unused time within a billing period.

Annual Memberships. Annual memberships are billed in full at the time of purchase. Cancellation stops automatic renewal only. You will retain full access through the end of your paid annual term. No prorated refunds are issued for unused time on annual plans unless otherwise required by applicable law.


5. Membership Refund Policy

All membership sales are final. The Habit Compass does not offer refunds on monthly or annual membership fees except where required by applicable law. This applies to all memberships, including Real Life Habit Members, Real Life with GLP-1, and The Compass Room.

If you believe a charge was made in error, contact us within 7 days of the charge and we will review your request.


6. Digital Products and Downloads

Digital materials provided through The Habit Compass, including but not limited to worksheets, toolkits, downloadable guides, meal plans, and frameworks, are delivered electronically as part of your membership or as standalone purchases where offered.

Because digital materials are delivered electronically and cannot be returned once access has been granted, all digital purchases are final and no refunds will be issued except as follows. If you experience a technical issue that prevents you from accessing a digital product you have purchased, contact us within 48 hours of your purchase and we will make every effort to resolve it. If the issue cannot be resolved due to a failure on our end, a refund may be issued at our sole discretion.

Change of mind, failure to use the product, or dissatisfaction with the content does not qualify for a refund on digital materials.


7. The Compass Room

The Compass Room is a premium small-group membership limited to a small number of seats. Membership is offered on an application and fit basis, and acceptance is at the sole discretion of The Habit Compass. The Compass Room is billed as a recurring monthly subscription at the rate shown at checkout and is subject to the same billing, cancellation, and refund terms as all other memberships.

Seats and Availability. The Compass Room is intentionally limited in size. When a member cancels, their seat remains active through the end of their paid billing period and then becomes available to the next applicant. Seats are not guaranteed and are subject to availability.

Direct Access. The Compass Room includes direct access to April Dearden through a private group hosted on WhatsApp. Direct access is available Monday through Friday, with a response commitment of within 24 hours during those days. Messages sent on weekends and holidays will be responded to on the next business day. This direct access is part of the program's educational support and is subject to the Educational Content Disclaimer in Section 2. It is not a medical, clinical, or emergency support channel.

Retreats and Special Experiences. All active members receive the same Preferred Member pricing on retreats and special experiences. Compass Room members receive priority early access, including a booking window ahead of general availability, to help secure a place before seats are released more broadly. Priority access does not guarantee availability.


8. WhatsApp and Communications Consent

WhatsApp (Compass Room). Membership in The Compass Room includes participation in a private WhatsApp group used to deliver direct access and program support. When you join The Compass Room, you provide a phone number at checkout for this purpose. Your consent to be contacted through WhatsApp is confirmed during onboarding. WhatsApp communications are used to deliver the program and are subject to WhatsApp's own terms and privacy practices. You may withdraw from WhatsApp communications at any time, though doing so may limit the direct-access benefit of The Compass Room.

Email. By purchasing a membership or product, you consent to receive transactional and program-related emails, including billing notices, onboarding, content updates, and account communications. These are necessary to deliver your membership.

SMS Marketing (optional and separate). The Habit Compass may offer optional SMS text messaging for reminders, updates, and marketing. Enrollment in SMS marketing is entirely optional, requires separate affirmative consent, and is never a condition of purchasing or using any product or membership. Where offered, you may opt in through a clearly marked, unchecked consent option, and you may opt out at any time by replying STOP or following the unsubscribe instructions provided. Message and data rates may apply. Providing a phone number for billing or for WhatsApp does not by itself enroll you in SMS marketing.


9. Access and Use

All products and memberships are for your personal use only. You may not share your login credentials, reproduce or distribute any content from The Habit Compass, or use any materials for commercial purposes without express written permission from The Habit Compass LLC. This includes all proprietary tools, frameworks, worksheets, and the methods taught within any program.

The Habit Compass reserves the right to suspend or terminate access for any member or customer found to be sharing credentials, redistributing content, or misusing any product, membership, or community channel, including the WhatsApp group. No refund is owed where access is terminated for violation of these terms.


10. Community and Conduct

Membership may include access to private community spaces and group communication channels. By participating, you agree to engage respectfully and constructively. The Habit Compass reserves the right to remove content, restrict participation, or terminate access for conduct that is abusive, harassing, disruptive, or otherwise harmful to the community, without refund.


11. Content Availability

The Habit Compass reserves the right to update, modify, add, or remove content from any program or product at any time. New pathways and content are added to memberships over time and are included as they become available. The Habit Compass does not guarantee that any specific future content will be released by a particular date.

Temporary interruptions in access may occur due to maintenance, updates, or technical issues beyond our control. The Habit Compass is not liable for any such interruptions.


12. Privacy and Health Information

Your personal information is collected and used in accordance with our Privacy Policy, available at thehabitcompass.com/privacy-policy. By purchasing any product or membership you consent to the collection and use of your information as described in the Privacy Policy.

The Habit Compass does not sell your personal information to third parties.

Voluntary Health-Related Information. Some Habit Compass forms, including the Compass Room application, may invite you to voluntarily share general information about your wellness goals or whether you are using a weight-loss medication. Providing this information is optional. It is used solely to recommend the program best suited to you and to tailor educational content. It is not used to provide medical advice, it is not shared or sold, and you may decline to provide it.


13. HIPAA Notice

The Habit Compass LLC is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA), and the educational services it provides do not create protected health information as defined by HIPAA. Any health-related information you choose to share with The Habit Compass is shared voluntarily and is handled in accordance with Section 12 and our Privacy Policy. Because The Habit Compass is an educational service and not a healthcare provider, you should not share sensitive medical records or detailed clinical information through any Habit Compass platform, program, or communication channel. General self-disclosure for program-matching purposes, as described in Section 12, is welcome and optional.


14. Limitation of Liability

To the fullest extent permitted by applicable law, The Habit Compass LLC, April Dearden, and any of their respective officers, directors, employees, contractors, agents, affiliates, successors, and assigns shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use any product or membership, including but not limited to loss of data, loss of revenue, loss of profits, or personal injury, even if advised of the possibility of such damages.

This limitation applies regardless of the legal theory under which the claim is brought, whether in contract, tort, negligence, strict liability, or otherwise.

Total liability in any matter arising from these terms shall not exceed the total amount paid by you to The Habit Compass in the three months preceding the claim.


15. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes arising under these terms shall be resolved in the courts of Palm Beach County, Florida.

17. Changes to These Terms

The Habit Compass LLC reserves the right to update these terms at any time. Active members and recent customers will be notified of material changes by email. Continued use of any Habit Compass product or membership following notice of changes constitutes acceptance of the updated terms.
