Terms of Service

1. Overview

These Terms of Service govern your access to and use of all programs, courses, memberships, digital products, and services offered by The Habit Compass, operated by April Dearden, Nutrition Educator and Habit Formation Specialist, doing business as The Habit Compass LLC.

The Habit Compass offers a range of educational products including but not limited to membership programs, self-guided courses, digital downloads, worksheets, frameworks, and future offerings as they become available. These terms apply to all current and future products and services unless separate terms are provided at the time of purchase.

By purchasing any product or membership you agree to these terms in full. If you do not agree, do not complete your purchase.


2. Educational Content Disclaimer

All content provided through The Habit Compass, including but not limited to lessons, modules, worksheets, frameworks, digital downloads, and written materials, is for educational purposes only.

Nothing in any Habit Compass program or product constitutes medical advice, nutritional counseling, diagnosis, treatment, or a therapeutic relationship. The Habit Compass is not a medical provider, registered dietitian, licensed nutritionist, or mental health professional.

Always consult a qualified healthcare provider before making any changes to your diet, exercise routine, medication, or health habits. Individual results vary and are not guaranteed.


3. Membership and Billing

Membership programs offered by The Habit Compass are recurring subscriptions billed at the rate shown at checkout. Your first payment is processed immediately upon purchase. Subsequent payments are charged automatically on the same date of each billing period, either monthly or annually depending on the plan selected.

You authorize The Habit Compass to charge your payment method on file for each renewal period until you cancel.

Prices are subject to change with reasonable advance notice provided to active members by email.


4. Membership Cancellation Policy

You may cancel your membership at any time through your member account portal. To cancel, log into your portal at membership.thehabitcompass.com, navigate to your account settings, and follow the cancellation steps.

Monthly Memberships Cancellation takes effect at the end of your current monthly billing period. You will retain full access to your membership content through the end of the period for which you have already paid. No partial refunds are issued for unused time within a billing period.

Annual Memberships Annual memberships are billed in full at the time of purchase. Cancellation stops automatic renewal only. You will retain full access through the end of your paid annual term. No prorated refunds are issued for unused time on annual plans unless otherwise required by applicable law.


5. Membership Refund Policy

All membership sales are final. The Habit Compass does not offer refunds on monthly or annual membership fees except where required by applicable law.

6. One-Time Digital Product Policy

One-time digital purchases including but not limited to self-guided courses, digital downloads, worksheets, toolkits, and any other standalone digital products are all sales final.

Because digital products are delivered electronically and cannot be returned once access has been granted, no refunds will be issued for one-time digital purchases under any circumstances except as follows.

If you experience a technical issue that prevents you from accessing a digital product you have purchased, contact us at [email protected] within 48 hours of your purchase. We will make every effort to resolve the issue. If the issue cannot be resolved due to a failure on our end, a refund may be issued at our sole discretion.

Change of mind, failure to use the product, or dissatisfaction with the content does not qualify for a refund on digital purchases.


7. Access and Use

All products and memberships are for your personal use only. You may not share your login credentials, reproduce or distribute any content from The Habit Compass, or use any materials for commercial purposes without express written permission from The Habit Compass LLC.

The Habit Compass reserves the right to suspend or terminate access for any member or customer found to be sharing credentials, redistributing content, or misusing any product or membership.


8. Content Availability

The Habit Compass reserves the right to update, modify, add, or remove content from any program or product at any time. Modules or features marked as Coming Soon will be added over time and are not guaranteed to be available by any specific date.

Temporary interruptions in access may occur due to maintenance, updates, or technical issues beyond our control. The Habit Compass is not liable for any such interruptions.


9. Privacy

Your personal information is collected and used in accordance with our Privacy Policy, available at thehabitcompass.com/privacy-policy. By purchasing any product or membership you consent to the collection and use of your information as described in the Privacy Policy.

The Habit Compass does not sell your personal information to third parties.


10. HIPAA Notice

The Habit Compass LLC is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). All content is educational in nature and does not involve the collection or handling of protected health information. Members and customers are advised not to share personal medical or health information within any Habit Compass platform, program, or communication channel.


11. Limitation of Liability

To the fullest extent permitted by applicable law, The Habit Compass LLC, April Dearden, and any of their respective officers, directors, employees, contractors, agents, affiliates, successors, and assigns shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use any product or membership, including but not limited to loss of data, loss of revenue, loss of profits, or personal injury, even if advised of the possibility of such damages.

This limitation applies regardless of the legal theory under which the claim is brought, whether in contract, tort, negligence, strict liability, or otherwise.

Total liability in any matter arising from these terms shall not exceed the total amount paid by you to The Habit Compass in the three months preceding the claim.


12. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes arising under these terms shall be resolved in the courts of Palm Beach County, Florida.

14. Changes to These Terms

The Habit Compass LLC reserves the right to update these terms at any time. Active members and recent customers will be notified of material changes by email. Continued use of any Habit Compass product or membership following notice of changes constitutes acceptance of the updated terms.
